Proceedings before the European Commission
Krka, d.d., Novo mesto (hereinafter Krka) announces the information that it had received the notice from the European Commission (hereinafter the Commission) on the initiation of the proceedings regarding potential unilateral behaviour by Les Laboratories Servier and Servier SAS, France (hereinafter referred to as Servier) as well as agreements between Servier and companies Krka, Lupin Ltd. (India), Matrix Ltd. (subsidiary of Mylan Inc., USA), Niche Ltd. (Ireland) and Teva Ltd. (Israel). The unilateral behaviour and agreements may have the object or effect of hindering generic entry of perindopril on markets of member states of European Economic Area (hereinafter referred to as EEA). The suspected practices constitute possible infringements of Articles 81 and 82 of European Community Treaty and Articles 53 and 54 of EEA Agreement by Servier and, for possible infringements of Article 81 of EC Treaty by the contracting parties of agreements with Servier.
The Commission is informing that the initiation of proceedings does not imply that the Commission has proof of an infringement, it solely signifies that the Commission is dealing with the case as a matter of priority.
Krka has already announced to the public the information on the Commission's investigation on 26 November 2008 and 6 January 2009.
