Temporary injunction for alleged patent infringement of esomeprazole patent in Estonia

On 2 July 2010 Krka, d. d., Novo mesto (hereafter referred to as Krka) received the decision of the Harju County Court, Estonia that temporarily prohibits Krka from importing, preparing, storing, using, distributing, offering and promoting its product ESCADRA® which contains the active ingredient esomeprazole in Estonia. The court has granted the temporary injunction on request of Astra Zeneca which believes that Krka's product infringes its Estonian patent 03157 which protects a special form of the active ingredient esomeprazole. The Court has granted the temporary injunction ex parte (without hearing).

Krka will file an appeal against this decision. Krka is confident that it does not infringe the patent, because its product does not contain a form of the active ingredient esomeprazole claimed in the Astra Zeneca patent.

Krka has started to market its product ESCADRA® in Estonia at the end of June, in other countries esomeprazole products has been marketed since March this year.
