Decision by the European Commission regarding perindopril

Krka, d. d., Novo mesto hereby informs the interested public that today it has received the Judgement of the General Court of the EU in the perindopril case.

The European Commission decided in 2014 that Krka had allegedly breached Article 101 of the Treaty on the Functioning of the European Union and caused distortion on the perindopril market in the EU, and imposed on Krka a fine in the amount of EUR 10,000,000. Krka paid the fine.

Krka filed a claim against the decision at General Court of the EU, because Krka believed that its actions had not caused a distortion or delay in launching of perindopril on the EU markets and had not breached competition rules.

The General Court announced the decision today. The General Court decided in favour of Krka, and found that Krka’s actions had not caused a distortion or delay in launching of perindopril on the EU markets and had not breached Article 101 of the Treaty on the Functioning of the European Union. Consequently, the General Court annulled the fine imposed on Krka.

The Commission can file an appeal against the decision of the General Court at the Court of Justice. In case of Commission appeal, Krka intends to form provisions in the amount of EUR 10,000,000 after the fine is returned.

Krka published the announcements considering the perindopril case on 26 November 2008, 6 January 2009, 8 July 2009, 3 July 2014 and 9 July 2014.
