Lawsuit for alleged infringement of the patent protecting the API montelukast in Slovenia

Krka d. d., Novo mesto (henceforth Krka) received a lawsuit on 5 December 2008, filed at the District Court in Ljubljana by Merck Frosst Canada Limited, Purdy's Wharf Tower One, 1959 Upper Water Street, Halifax, Nova Scotia, Canada, against defendant parties Salus, d. d., Mašera Spasičeva ulica 10, Ljubljana, Slovenija and Krka, due to alleged infringement of the patent protecting the active ingredient montelukast. The plaintiff requires that both defendant parties are prohibited from manufacturing, selling, offering for sale, marketing and importing of the product Monkasta or any other product containing active pharmaceutical ingredient montelukast in Slovenia and pay damages for patent infringement in the sum of EUR 67,916.77 with penalty interest from the day when lawsuit was filed up to the payment date.

The Court has already rejected the matter, claimed by the plaintiff, with a temporary injunction. Krka informed the public about this decision on 13 March 2008.
