Annulment of temporary injunction for alleged patent infringement of donepezile tablets in Norway

Krka, d. d., Novo mesto (hereinafter Krka) announces to the interested public that Krka`s subsidiary Krka Sverige AB (hereinafter Krka Sverige) received on 12 March 2009 the decision of the Higher Court in Oslo, Norway which annuls the temporary injunction of the Executive Court in Oslo, Norway dated 18 November 2008 in the dispute for alleged infringement of the patent for production of donepezil active pharmaceutical ingredient in Norway between the companies Pfizer AS, Norway and Eisai Co, Ltd., Japan (the "plaintiffs") and Krka Sverige, which prohibited Krka Sverige to begin manufacturing and marketing products containing donepezile as active pharmaceutical ingredient in Norway.

By issuing such decision Higher Court in Oslo has confirmed that Krka Sverige does not infringe the patent of the plaintiffs.

Krka Sverige AB will now start to market the product with donepezile as active pharmaceutical ingredient in Norway.

The procedure regarding alleged patent infringement is still ongoing. Based on current findings and legal arguments during the temporary injunction procedure, Krka believes that it will prove that Krka Sverige does not infringe the patent.
