Amendment to the lawsuit for alleged infringement of the montelukast patent in Slovenia

Krka d.d., Novo mesto (hereafter Krka) received an amendment to the lawsuit filed at the District Court in Ljubljana by Merck Frosst Canada Limited, Purdy's Wharf Tower One, 1959 Upper Water Street, Halifax, Nova Scotia, Canada, against defendant parties Salus, d.d., Mašera Spasičeva ulica 10, Ljubljana, Slovenija and Krka, for alleged infringement of the patent protecting the montelukast active pharmaceutical ingredient. In addition to the initial claim for damages in the amout of EUR 67,916.77 and penalty interest from the date of the lawsuit filling until damages payment, the plaintiff raised its claim for EUR 1,000,000.00. Therefore the total damages claimed are EUR 1,067,916.77.

With the lawsuit from 5 December 2008, the plaintiff required that both defendant parties are prohibited from manufacturing, selling, offering for sale, marketing and importing of the product Monkasta or any other product containing montelukast active pharmaceutical ingredient in Slovenia and pay damages for patent infringement. The Court has already rejected the plaintiff's motion for temporary injunction in this case. Krka informed the public about these developments on 13 March 2008 and 5 December 2008.
