Decision of the Higher Court in Ljubljana in the Valsaden case

According to the Article 386 of the Market in Financial Instruments Act, Krka, d. d., Novo mesto (hereinafter Krka) announces to the interested public that on 2 June 2009 received the decision of the Higher Court in Ljubljana. The Higher Court in Ljubljana has refused the appeal filed by Novartis AG, Basel, Switzerland against the decision of the District Court in Ljubljana dated 17 February 2009 and has confirmed the decision of District Court in Ljubljana, which annulled the temporary injunction dated 12 January 2009, that prohibited Krka to manufacture and market the product Valsaden, film coated tablets in all strengths, or whichever other product that may infringe patents EP 0914 119 or EP 1 410 797, in Slovenia.

The Higher Court decision is final, for this reason Krka will again enter the Slovenian market and start marketing of the product Valsaden in Slovenia.

Krka published the information about temporary injunction on 14 January 2009 and the information about the annulment of that temporary injunction on 19 February 2009.
