INI-1558/10 KRKA, d. d., Novo mesto Temporary injunction for alleged infringement of the patent protecting telmisartan active ingredient production process
Krka, d. d., Novo mesto is informing the public that its subsidiary Krka-Polska Sp. z o.o., Warsaw (hereafter Krka Polska) has received the decision of the District Court in Warsaw which has granted a temporary injunction and prohibited Krka Polska from offering and marketing the medicine Tolura containing the active ingredient telmisartan in Poland, due to alleged infringement of the patent PL 169 675.
By granting the temporary injunction the Court has complied with request of the patentee, Dr. Karl Thomae GmbH, Germany. The court has granted the temporary injunction without hearing (ex parte), thus without obtaining a response and evidence from Krka Polska. Krka Polska will file an appeal against the court decision, however the appeal is not suspensive.
Dr. Karl Thomae GmbH was ordered to file a submission for alleged patent infringement within 14 days. Otherwise the temporary injunction will cease to be valid.
The patent PL 169 675 protects one of the processes for telmisartan active ingredient production. Krka´s production process is different, which to its best knowledge does not fall into the scope of this patent.
Krka Polska has been selling the product Tolura in Poland since October 2010. Krka, d. d., Novo mesto
