Revoked temporary injunction relating to olanzapine tablets production process patent infringement

On 27 October 2008 Krka, d.d., Novo mesto (hereafter Krka) received the order of the District Court in Ljubljana by which the court decided in favour of Krka and revoke its previous order according to which Krka was prohibited to manufacture and market the product Zolrix or other products containing olanzapine as active pharmaceutical ingredient in Slovenia.

Accordingly, Krka can continue manufacturing and selling its product Zolrix in Slovenia. Krka believes that its product Zolrix does not infringe patent rights of Eli Lilly in Slovenia.

In 2007 the sales of Zolrix in Slovenia were less than EUR 100,000. The estimated sales of the same product in Slovenia for 2008 are EUR 200,000 and for 2009 the planed product sales are EUR 1,000,000.

Krka has released the information about this dispute on 4 February 2008 and 12 March 2008.
