Temporary injunction for alleged patent infringement of donepezile tablets manufacturing in Norway

The Executive Court in Oslo, Norway, issued a temporary injunction prohibiting Krka Sverige AB to begin manufacturing and marketing products containing donepezile as active pharmaceutical ingredient in Norway. The court decided in favour of the plaintiffs - Pfizer AS, Norway and Eisai Co, Ltd., Japan, provided that two conditions are met: the plaintiffs must file a lawsuit for alleged patent infringement no later than 31 December 2008 and pay the security in the sum of EUR 4 million to cover the incurred loss of Krka, should the court in the infringement case decide in favour of Krka, i.e.finding that does not infringe the patent. Krka believes that both plaintiffs will comply with the above terms and that the temporary injunction will remain in force.

Krka will file an appeal against the decision. Krka believes it has strong arguments for proving that it does not infringe the relevant patent.

Krka Sverige AB has not yet marketed any product with donepezile active pharmaceutical ingredient in Norway.
