Krka was not obliged to disclose information on the European Commission investigation

With reference to the announcement dated 26 November 2008 referring to the visit of European Commission's representatives to Krka, which Krka published upon the recommendation of the Ljubljana Stock Exchange due to the company's allegedly improper conduct concerning this visit, Krka announces that the company was officially informed by the Slovenian Securities Market Agency that no facts actually exist on whose basis Krka might be or would have to be reproached for improper information disclosure practice.

As proceeds from the explanations sent to the Slovenian Securities Market Agency by the European Commission, the duty to disclose the details on the course of investigation did not exist as regards the competition law, since the case involved an inspection visit and the European Commission formally did not institute any proceedings against Krka. The European Commission will reveal the results of its visit at a considerably later stage, only in case it decides to formally institute the relevant proceedings.
