Pursuant to the provisions of the Rules of the Ljubljana Stock Exchange and the valid legislation, Telekom Slovenije, d.d., hereby publishes the following notification on receiving a decision in an important legal procedure:

Today, on 31 March 2023 Telekom Slovenije, d.d., received the decision of the Slovenian Competition Protection Agency (hereinafter: AVK) with which AVK informs it that the procedure of establishing a violation of Article 9 of the Prevention of Restriction of Competition Act has been stopped.

AVK launched the procedure on 4 October 2004 ex officio, following a consumer complaint regarding the abuse of dominant position on the carrier market of broadband bitstream access over the copper network in the Republic of Slovenia (ADSL connection requiring an ISDN lease).

On 25 October 2013 AVK issued a decision establishing that, in the period between 1 December 2002 and 5 September 2005, Telekom Slovenije, d.d., abused its dominant position on the bitstream broadband access carrier market over copper network, which the Administrative Court of the Republic of Slovenia first upheld, however, the Supreme Court of the Republic of Slovenia then upheld the appeal from Telekom Slovenije, d.d., and annulled the ruling from 9 December 2014 due to misapplication of material law, returning the matter to the Administrative Court of the Republic of Slovenia for a retrial. In the ruling from 3 November 2015 said court upheld the lawsuit from Telekom Slovenije, d.d., suspending AVK’s decision of 25 October 2013, and returning the matter to AVK to repeat the procedure.

Having completing the new procedure, AVK issued a decision on 30 March 2023 on stopping the procedure with the explanation that in the repeated procedure and following the court’s instructions it did not manage to obtain evidence on the existence of an appropriate technical solution before 3 March 2005, and therefore calculate the economic effect.
